Other Information

The University of New South Wales (UNSW) and the National Centre of Excellence in Intellectual Disability Health (the Centre) must follow the laws in the Anti-Discrimination Act 1977 (NSW).

  • We will call it the Anti-Discrimination Act

The Anti-Discrimination Act helps stop discrimination in New South Wales.

  • Discrimination is when someone is treated differently because of something about themselves that they cannot change. These things are called characteristics.

Characteristics include things like:

    • Gender
    • Age
    • Disability
    • Race

An example of discrimination is when someone is not chosen for a job just because they have a disability.

Sometimes there are important reasons why a job should only be available to people who have certain characteristics.

When this happens, employers can be given an exemption from sections of the Anti-Discrimination Act.

  • An exemption means that the employer has been told that it is OK not to follow certain rules in the Anti-Discrimination Act
    • This means that it does not count as discrimination
  • Section 126 is the part of the Anti-Discrimination Act that has information about exemptions

Using Section 126 of the Anti-Discrimination Act, UNSW and the Centre were given exemptions to sections 49D and 51 of the Anti-Discrimination Act. This means that UNSW and the Centre can:

  • Make research and project jobs that are only for people with intellectual disability
    • This is called designating a job
  • Make announcements that these jobs are only available to people with intellectual disability
    • This is called advertising a job
  • Choose a person for a job because they have intellectual disability
    • This is called recruiting for the job

It is important to UNSW that:

  • Lots of different people work at UNSW. This includes:
    • People who have different experiences of:
      • Gender identity
        • This means if a person is a man, woman, or non-binary. It might be different to the gender a person was given when they were born.
      • Sexual orientation
        • This means who a person is attracted to
      • Cultural and linguistic backgrounds
        • This is the way people live their lives
        • The things that are important to them
        • The languages that they use
    • Aboriginal and Torres Strait Islander people
    • People with disability
    • People who have responsibilities as a carer or family member
  • Everyone is included at UNSW
  • Everyone feels supported to work at UNSW
    • Flexible work options are ways of working that meet the needs of individual people
  • Everyone has access to the things they need to do their job at UNSW
    • These are called workplace adjustments

It is important that UNSW finds the right person for the right job.

There might be times when UNSW decides that a person or a job is no longer the right match for UNSW.

Under the provisions of section 126 of the Anti-Discrimination Act 1977 (NSW), an exemption is given from sections 49D and 51 of the Anti-Discrimination Act 1977 (NSW) to the University of New South Wales to advertise, designate and recruit research and project support roles for the National Centre of Excellence in Intellectual Disability Health for people who self-identify as having an intellectual disability.

UNSW is committed to evolving a culture that embraces equity and supports a diverse and inclusive community where everyone can participate fairly, in a safe and respectful environment. We welcome candidates from all backgrounds and encourage applications from people of diverse gender, sexual orientation, cultural and linguistic backgrounds, Aboriginal and Torres Strait Islander background, people with disability and those with caring and family responsibilities. UNSW provides workplace adjustments for people with disability, and access to flexible work options for eligible staff.

The University reserves the right not to proceed with any appointment.
